Welcome to Rádio Indoor! These Terms of Service ("Terms") govern your access to and use of our online services, including our website and audio platform ("Service"), provided by PostTree LLC.
1. Description of the Service
Rádio Indoor is a professional in-store audio platform for retailers, chains, and any point of sale. Our Service offers:
- Background music via streaming, with an extensive and continuously updated catalog;
- AI-generated playlists tailored to your venue's profile;
- Voiceovers with humanized AI voices for announcements, jingles, and internal communications;
- Automated scheduling by time of day, day of the week, and shift;
- Integrated audio studio (editor, mixer, and recorder) built into the browser;
- Multi-store management with content sharing across locations.
2. Acceptance of the Terms
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the terms, you may not access the Service. You must be at least 18 years of age to use our Service.
3. Accounts and Requirements
When you create an account with us, you must provide information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password you use to access the Service and for any activities or actions taken under your password.
Minimum Age: You must be at least 18 years of age to create an account and use our Service.
4. Billing Model and Payments
Our Service operates on a recurring subscription basis. Plans may be billed monthly or annually, as selected at the time of sign-up. Access to features depends on an active subscription.
Payment Method: A valid payment method (credit card) is required to use the Service. We use Stripe, a certified and secure third-party payment processor, to process all transactions. We do not store your credit card information on our servers.
Automatic Renewal: Subscriptions renew automatically under the same conditions unless you cancel before the end of the billing period.
Cancellation: You may cancel your subscription at any time through your account settings. After cancellation, you will continue to have access to the Service until the end of your current billing period. No further charges will be made after the end of the paid period.
Refund Policy: Subscription fees are non-refundable, except where required by applicable law or at the sole discretion of PostTree LLC under exceptional circumstances.
5. Payment Disputes and Chargebacks
If you initiate a payment dispute (chargeback) with your bank or card issuer, your account will be immediately suspended until the dispute is resolved. If the dispute is resolved in our favor, your account will be reactivated. Improper disputes may result in the permanent cancellation of your account.
If you have any issue with a charge, please contact us before initiating a dispute so we can resolve the matter amicably.
6. Content and Intellectual Property
Our Service allows you to create playlists, configure automated schedules, generate AI voiceovers, upload audio, and store recordings ("Content").
Your Settings and Data: The playlists, schedules, recordings, and other configurations you create remain your property. You grant us a limited license to process and store this data for the sole purpose of operating and providing the Service.
AI-Generated Content: Voiceovers and playlists generated by artificial intelligence within your account may be freely used for the commercial and operational purposes of your business. PostTree LLC reserves the right to use aggregated and anonymized data to improve the Service.
Music Catalog: Access to the streaming music catalog is provided under license from the respective rights holders. You agree to use the catalog only within the terms of the Service and in venues where in-store audio playback is permitted.
Copyright and Public Performance: In some countries and jurisdictions, the public performance of music in commercial venues may be subject to royalty payments to collective management organizations (such as ECAD in Brazil, ASCAP/BMI in the United States, etc.). It is your responsibility to verify and comply with the obligations applicable to your establishment.
Data Deletion: When you delete your account, your settings, playlists, recordings, and other data will be permanently deleted from our systems after a 30-day retention period. This window allows you to recover your account if you deleted it by mistake.
7. Use of Artificial Intelligence
Our platform uses state-of-the-art artificial intelligence models to generate playlists and voiceovers. However, you acknowledge and agree that:
- AI-generated content may contain inaccuracies, errors, or unexpected variations;
- PostTree LLC does not warrant the accuracy, completeness, or fitness of generated content for any specific purpose;
- You are responsible for reviewing and validating all generated content before using it publicly;
- Use of generated content is at your own risk, especially when intended for public communication.
8. Acceptable Use
You agree not to use the Service to:
- Create, store, or distribute illegal, fraudulent, offensive, or malicious content;
- Infringe the intellectual property rights of third parties;
- Broadcast misleading, false, or consumer-rights-infringing communications;
- Attempt to compromise the security or availability of the Service;
- Play the music catalog in unauthorized venues or for unintended purposes;
- Generate content that violates laws applicable in your jurisdiction.
Violations of these policies may result in the immediate suspension or cancellation of your account, with no right to a refund.
9. Discontinuation of Features
We reserve the right to discontinue or modify any feature of the platform. In the event of a material discontinuation of contracted features, we will notify active users at least 60 (sixty) days in advance via the email address on file.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms. You may terminate your account at any time through your account settings or by contacting us.
After your account is terminated, your data will be retained for 30 days to allow recovery, after which it will be permanently deleted.
11. Service Availability
While we strive to keep the Service available 24/7, we do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We may temporarily suspend access to the Service for maintenance, updates, or technical reasons. In the event of an internet outage at your venue, Rádio Indoor may continue playing locally cached content where that feature is available, but uninterrupted continuity is not guaranteed.
12. Limitation of Liability
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. Under no circumstances shall PostTree LLC be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your access to or use of (or inability to access or use) the Service;
- Inaccuracies or errors in AI-generated content;
- Loss of data, profits, or business opportunities;
- Interruptions, Service failures, or unavailability of any specific music catalog;
- Copyright obligations not fulfilled by the user in their jurisdiction.
13. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
